HUME GMBH owns and manages the website www.betterchecked.com (hereinafter referred to as the “Website”). The Website provides informational and entertainment content consisting of reviews, promotional codes, extensive reviews, recommendations and rankings relating to online mystery boxes. HUME GMBH does not sell nor offer mystery boxes and further does not facilitate the purchase thereof.

The present Terms of Service shall govern the terms upon which users may visit, access and use the Website. 

1. DEFINITIONS

When employed in these Terms of Service, the following capitalized terms shall have the meanings set forth below:

“Content” shall refer to all information and reference content and material offered on the Website. 

“HUMMEL MEDIA” shall refer to HuMe GmbH, the Austrian company that owns, operates and manages the Website. 

“Terms of Service” shall refer to the present Terms of Service and all modifications and updates thereto made by HUMMEL MEDIA.

“Third Party Sites” shall refer to third party websites, sites, applications, systems, products and services linked or otherwise referenced on the Website, which may include mystery box providers.

“Users” shall refer to all users of the Website collectively, and “User” shall refer to any individual user of the Website. 

2. APPLICATION OF THESE TERMS OF SERVICE

The present Terms of Service set forth the terms upon which Users may use the Website. The present Terms of Service shall be enforceable and binding upon the access, visit or use of the Website by Users. 

By using the Website, or engaging with the Website in any way, Users agree to be bound by these Terms of Service. Use of the Website signifies Users’ agreement to be subject to these Terms of Service, in full and without restriction, as though Users manually signed them. 

The present Terms of Service encompass any other rules or policies implemented by HUMMEL MEDIA, including but not limited to HUMMEL MEDIA’S Privacy Policy.

3. BINDING TERMS

These Terms of Service constitute a binding and enforceable agreement between Users and HUMMEL MEDIA with respect to their usage of the Website and the Content provided thereon. 

Users acknowledge that HUMMEL MEDIA shall not be bound by any terms or agreements except for the present Terms of Service, unless otherwise indicated in these Terms of Service or as specified in writing by HUMMEL MEDIA. 

If a User does not agree with these Terms of Service, in full or in part, the User’s sole recourse shall be to not use the Website. 

4. ELIGIBILITY

To be eligible to use the Website, Users represent the following to HUMMEL MEDIA:

1. Each User is at least eighteen (18) years old. 
2. Each User agrees to use the Website in compliance with all applicable laws, regulations and policies.
3. Each User is not subject to any limitations or restrictions that would prevent, restrict or limit its use of the Website.

5. UPDATES TO THESE TERMS OF SERVICE

HUMMEL MEDIA reserves the right to update these Terms of Service without notice, at its discretion. The latest version of these Terms of Service shall be binding and effective as of the publication on the Website. 

In consideration thereof, HUMMEL MEDIA encourages Users to review these Terms of Service periodically to ensure familiarity with the latest version. 

Any access to or use of the Website following the publication of the updated Terms of Service constitutes Users’ acceptance of such updated Terms of Service. 

6. CONTENT OFFERED ON THE WEBSITE

The Website provides informational, reference and entertainment Content, consisting of reviews, best-of lists, promotional offers and editorial commentary about mystery box platforms. The Content published on the Website is provided for reference and informational purposes only. 

Users may subscribe to newsletters and promotional codes alerts provided on the Website.

The information published on the Website is intended to be construed as general information regarding mystery boxes and companies offering the same. The Content is not intended to be construed as advice. The content published on the Website is for convenience and reference, and should not be construed as a replacement for professional consultations. 

7. DISCLAIMERS REGARDING CONTENT 

HUMMEL MEDIA employs strict processes to ensure the Content published on the Website is accurate, updated and relevant, however, HUMMEL MEDIA does not provide any guarantees regarding the reliability of the Content. Users acknowledge that reliance on any statement or information published on the Website shall be at their sole risk. 

HUMMEL MEDIA reserves the right to correct any inaccuracies, errors or omissions on the Website. HUMMEL MEDIA further reserves the right to make changes to the Website and the Content provided thereon at any time, at HUMMEL MEDIA’s sole discretion.

In consideration of the above, Users agree to assume all risks associated with decisions, actions and omissions made on the basis of the information provided on the Website. HUMMEL MEDIA declines all liability for actions, inactions and decisions made by the User in reliance upon the information published on the Website.

8. PAYMENTS

At this time, Users may not purchase products or services from HUMMEL MEDIA via the Website. The Website may contain links to third-party websites offering products or services. If Users purchase through such a link, HUMMEL MEDIA discloses that it may receive a commission from the third-party provider. 

9. OBLIGATIONS RELATING TO THE USAGE OF THE WEBSITE

Users shall be responsible for using the Website in accordance with these Terms of Service, and applicable laws and regulations. Users agree not to engage in unacceptable use of the Website, which includes, but is not limited to using the Website:

• For unlawful or illegitimate purposes;
• To share, transmit or otherwise maliciously download a virus or harmful components;
• To hack, install spyware, or reverse engineer the Website; or
• To damage, disable or attempt to delete the Website, or any portion thereof.

The list of prohibited behavior on the Website provided hereinabove is for illustration purposes only. 

10. COMMENTS ON CONTENT

The Website uses a third-party service, Hyvor Talk to allow Users to leave comments on existing posts, lists and reviews. Users may comment anonymously or by creating a Hyvor account. HUMMEL MEDIA does not operate Hyvor Talk and is not responsible for its availability, performance, or terms. Users are subject to Hyvor Talk’s own Terms of Service when using the comment plugin.

HUMMEL MEDIA moderates the comment sections to maintain a respectful and safe environment. While no automated pre-publication filtering is applied, HUMMEL MEDIA reserves the right to review and remove, at its sole discretion, any comment that is harmful, offensive, unlawful, or otherwise inappropriate.

11. WRITING COMMENTS

When writing a comment, Users should ensure it is truthful, accurate and fair. Accordingly, the comments submitted must be truthful, accurate and should be a proper reflection of the service and/or product received. 

Users are responsible for taking all necessary precautions to ensure the comments they publish do not violate any third party rights or any intellectual property laws. 

12. LIABILITY FOR COMMENTS

Users are solely responsible for any comments they share on the Website. 

Considering comments are User-generated, HUMMEL MEDIA is unable to guarantee the quality, suitability and integrity of any such comments. HUMMEL MEDIA shall not be liable for any errors, issues or losses caused by comments published on the Website. Further, HUMMEL MEDIA disclaims all warranties and guarantees in connection with such comments published on the Website. HUMMEL MEDIA does not guarantee that the comments shall be appropriate, accurate and without error. 

13. LICENSE TO COMMENTS 

Users hereby grant HUMMEL MEDIA and its affiliates an exclusive, worldwide, perpetual, irrevocable, royalty-free and transferable license to use, publish, distribute, modify and commercialize any comments they publish on the Website, in any and all media or form of communication, whether now existing or hereafter developed. 

HUMMEL MEDIA reserves the right to edit, delete, or remove such comments for any reason HUMMEL MEDIA deems proper or appropriate, at its sole discretion.

14. COMMENT REMOVAL

HUMMEL MEDIA cannot review all comments prior to their publication on the Website.  Further, HUMMEL MEDIA is under no obligation to remove any comments from the Website, however, HUMMEL MEDIA may, at its discretion, remove comments that infringe these Terms of Service or applicable laws or regulations.

15. DISCLAIMERS REGARDING ADVERTISING 

The Website displays advertisements, which may include images, videos, written recommendations, listings or embedded iframes. HUMMEL MEDIA also publishes editorial content such as promo codes, reviews, and “best of” lists relating to third-party mystery box providers.

HUMMEL MEDIA does not own, operate, or control any mystery box providers promoted on the Website. HUMMEL MEDIA’s role is limited to providing advertising space and Content. As such, HUMMEL MEDIA expressly disclaims all operations provided by the mystery box providers. 

Mystery boxes, commonly referred to as loot boxes, may be regulated as gambling in certain jurisdictions and may be prohibited in some countries. The legal status of these services varies by location. It is Users’ sole responsibility to determine whether participation in any mystery box use and purchase is legal in their country of residence. Users shall be responsible for complying with applicable laws and regulations in their jurisdictions.

HUMMEL MEDIA does not provide any representations or warranties regarding the legality, security or reliability of any third-party service promoted on the Website. Users acknowledge that participation in mystery box purchases may result in financial loss.

All reviews, rankings, and recommendations on the Website are provided for informational and entertainment purposes only and do not constitute financial, gambling or legal advice. Use of any promoted service is entirely at Users’ own risk.

16. INTELLECTUAL PROPERTY 

The content published on the Website may include trademarks, intellectual property, graphics, logos, text, images, marketing materials and other proprietary documentation. The Content is proprietary to HUMMEL MEDIA and may not be copied, distributed, reproduced or shared without referencing HUMMEL MEDIA as the author thereof.

Any intellectual property published on the Website, including trademarks, intellectual property, marketing materials and other proprietary documentation may be protected by intellectual property laws. All rights related thereto are reserved. 

These Terms of Service shall not be construed as granting Users a license or right to any trademarks, intellectual property, marketing materials or other proprietary documentation of HUMMEL MEDIA, or any of its affiliates, if applicable.

17. WARRANTY AND GUARANTEE DISCLAIMERS

To the fullest extent permitted by applicable law, the Website is provided “as is” and “as available” without any warranties of any nature, whether express, implied, or statutory. 

HUMMEL MEDIA does not warrant that the Website shall be accessible at all times, without error or interruptions. Users acknowledge that HUMMEL MEDIA shall not be liable for any service interruptions, including, without limitation, system failures, power outages, or other interruptions due to causes outside of HUMMEL MEDIA’s control.

18. EXCLUSIONS OF LIABILITY

To the fullest extent permitted by applicable law, HUMMEL MEDIA shall not be liable for any claims, demands, actions, causes of action, damages, losses, liabilities, costs and expenses arising out of or in connection with Users’ usage and access to the Website and the Content provided thereon.

HUMMEL MEDIA further declines all liability for any incidental, indirect, or consequential damages, technical issues, system failures, loss of business, injuries and damages of any nature, except to the extent prohibited by applicable law. 

19. THIRD PARTY SITES

The Website may refer to Third Party Sites. Unless otherwise indicated by HUMMEL MEDIA, HUMMEL MEDIA is not affiliated with the Third Party Sites, nor does HUMMEL MEDIA endorse or sponsor such Third Party Sites. The links on the Website to the Third Party Sites are for convenience and reference purposes only.

The Third Party Sites are independent to HUMMEL MEDIA. HUMMEL MEDIA makes no representations and provides no guarantees with respect to (i) the availability of the Third Party Sites and (ii) the services and/or products offered by the Third Party Sites. 

20. ENTIRE AGREEMENT

The present Terms of Service, including any policies referenced herein, constitute the entire agreement between HUMMEL MEDIA and Users with respect to the subject matter contemplated in these Terms of Service, and the latest version of these Terms of Service shall supersede all prior negotiations and agreements between HUMMEL MEDIA and the Users regarding the subject matter hereof.

21. WAIVERS

HUMMEL MEDIA shall not be deemed to have waived any of its rights or privileges under these Terms of Service, by conduct, lapse of time or by any statement or representation other than (i) by an authorized representative of HUMMEL MEDIA and (ii) in an explicit signed written waiver. 

22. SEVERABILITY

Any provision of these Terms of Service which is found to be illegal or unenforceable by a competent legal authority or court shall be severed from these Terms of Service. The remaining provisions shall remain enforceable and binding.

23. NOTICES AND CORRESPONDENCE (IMPRINT)

Any notices Users intend to address to HUMMEL MEDIA should be provided in writing. Such notices may be sent on the Website, by email or by first class certified or registered mail to our corporate headquarters located as follows:

24. GOVERNING LAW

These Terms of Service are governed by the laws in effect in the Republic of Austria.

25. QUESTIONS AND COMMENTS

Users may submit questions and comments regarding these Terms of Service to HUMMEL MEDIA by sending an email. Any reported breaches of these Terms of Service should also be submitted to HUMMEL MEDIA by email.
